These Terms of Use ("Terms") govern your access to and use of mrpandadrawz.com (the "Site"), operated by Marcel ("Mr. Panda", "we", "us", "our") from the Republic of South Africa. By visiting the Site, creating an account, subscribing, or making a purchase, you agree to these Terms. If you do not agree, please don't use the Site.

1. Who we are

The Site is the personal portfolio and shop of an independent digital artist working under the name Mr. Panda Drawz. All correspondence should reach us at the email address listed in the Privacy Policy. We are a sole proprietor based in South Africa.

2. Eligibility

You must be at least 13 years old to use the Site at all, and at least 18 years old to access any content marked as NSFW (not safe for work) or to enter into a paid subscription. We may ask you to verify your age. If you cannot or will not, we will not show you NSFW content or accept your purchase.

Visitors located in the United Kingdom (including the Crown dependencies of Jersey, Guernsey, and the Isle of Man) cannot access the adult section. The UK Online Safety Act requires "highly effective" age assurance provided by a regulated third party for that material; the studio is a sole-proprietor operation and does not currently maintain such a provider. The rest of the Site (portfolio, lore, shop, subscriptions where offered) remains freely available.

By subscribing or purchasing, you represent that you have the legal capacity to enter into a binding contract under the laws of your country.

3. Your account

If you create an account, you are responsible for keeping your login details safe and for everything that happens under your account. Tell us immediately if you suspect unauthorised access. You may not share your account or use anyone else's. We may suspend or delete accounts that breach these Terms.

4. Intellectual property

All artwork, illustrations, character designs, written lore, and other creative material on the Site are the original work of Marcel and remain the copyright of the artist. You receive a personal, non-transferable, non-commercial licence to view this content while these Terms are in force.

You may not:

  • Copy, redistribute, or republish the artwork in any medium without written permission;
  • Use the artwork to train machine-learning models or AI systems;
  • Sell, sublicense, or commercially exploit the artwork or any derivative;
  • Remove watermarks, signatures, or attribution.

If you purchase a print or digital file from us or from one of our authorised print partners (Displate, INPRNT, TeePublic), the licence is for personal display only unless explicitly stated otherwise on the listing.

5. Subscriptions and recurring billing

Subscriptions are processed by Paystack as our merchant of record. By subscribing you authorise Paystack to charge the payment method you provide on the cadence shown at checkout (monthly or yearly), until you cancel. Cancelling stops future renewals; the current paid period continues to its end date.

You can manage and cancel your subscription from your account at any time. You may also cancel by emailing us at the address in the Privacy Policy and we will action it within two business days.

We do not generally offer refunds on partially-used subscription periods. Statutory refund rights under South African or your local consumer-protection law are not affected by this policy.

6. One-off purchases

One-off purchases (digital files, prints, tips) are also processed via Paystack. Digital goods become available immediately on payment and, except where required by law, are non-refundable once delivered. Physical goods are fulfilled by us or by a third-party print partner; delivery times and shipping rules are shown on the relevant listing.

If a product is faulty or materially different from its description, contact us within 14 days of receipt and we will arrange a refund or replacement under the South African Consumer Protection Act.

7. Acceptable use

You agree not to:

  • Attempt to access systems, accounts, or data you are not authorised to access;
  • Probe, scan, or test the Site's security without our written permission;
  • Use scrapers, bots, or automated tools to download artwork in bulk;
  • Misrepresent your age, identity, or location;
  • Upload, transmit, or link to anything illegal, defamatory, or harmful.

8. Third-party links

The Site links out to platforms we use elsewhere (Instagram, X/Twitter, Ko-Fi, Displate, INPRNT, TeePublic, etc.). We are not responsible for the content, privacy practices, or terms of those platforms — please read theirs.

9. Disclaimer and limitation of liability

The Site is provided "as is". We make no warranty that it will be uninterrupted, error-free, or fit for any particular purpose. To the fullest extent permitted by law, our total liability to you for any claim arising from these Terms is limited to the amount you have paid us in the 12 months before the claim arose.

Nothing in these Terms excludes liability that cannot lawfully be excluded under South African law or any other mandatory consumer-protection regime that applies to you.

10. Termination

We may suspend or close your access to the Site (including paid subscriptions) at any time if you breach these Terms or if continuing to provide service to you would be unlawful. We will give you notice and a refund of any unused prepaid period where it is reasonable to do so.

You may stop using the Site at any time. If you have an account, you can request deletion from the account settings or by emailing us.

11. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. The courts of South Africa have non-exclusive jurisdiction over any dispute. If a mandatory consumer-protection law of your country gives you stronger rights, those rights apply too.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above shows the most recent change. Significant changes will be flagged on the Site or by email if you have an account. Continuing to use the Site after a change means you accept the updated Terms.
